Reservation

Acknowledging these terms is required to reserve the date(s) and time(s) of an appointment. If an appointment is rescheduled, postponed, or cancelled, the Client is responsible for payment of any Roisum Residential material charges incurred up to the time of cancellation.

Safety

At the time of the appointment, the homeowner, tenants, and their family members may not be present. This is for the safety of the photographer, our company’s liability, and the quality of the photos. If someone must be present, it may only be the Realtor® named on the listing agreement.

Roisum Residential reserves the right to terminate or reschedule coverage and leave the appointment location if the photographer experiences inappropriate, threatening, hostile, or offensive behavior from anyone at the appointment, or if the photographer’s safety is in question.

Shooting time & additions

Cooperation and punctuality are essential to accomplish the goals of all parties. Shooting begins at the scheduled start time and ends on or before the scheduled end time. If the Client is not prepared, or the home is not photo-ready at the scheduled time, the appointment will be rescheduled. Any time beyond the scheduled end time will be billed to the Client. If the property is not accessible at the scheduled time, Roisum Residential is not obligated to provide services for that appointment.

Travel

Appointments booked online are limited to the Idaho Falls, Rigby, and Shelley areas and require no travel fee. Other areas may not be booked online; travel fees for those areas are listed at roisum-residential.com. Roisum Residential reserves the right to adjust travel fees as needed, including for changes in fuel prices and vehicle maintenance and wear.

Responsibilities

Roisum Residential is not responsible for compromised coverage caused by factors beyond its control, including but not limited to obtrusive guests, lateness of the client or homeowners, weather conditions, scheduling complications, incorrect addresses provided to us, the state of home décor or staging, or restricted access to the location. Roisum Residential is not responsible for backgrounds or lighting conditions that may negatively affect or limit coverage, and will not be held accountable for failing to deliver images to anyone other than the Client.

Location limitations

Roisum Residential is bound by the rules and guidelines of each location, and the Client agrees to accept the technical results of those limitations. Negotiating with location officials to relax any guideline is the Client’s responsibility; Roisum Residential will offer technical recommendations only.

Permits

The Client is responsible for obtaining all permits and permissions required for any location where Roisum Residential will provide services.

Photographs & copyright

All photographs produced by Roisum Residential are protected by federal copyright law (all rights reserved) and may not be reproduced in any manner without our express written permission.

Once the Client has paid in full for all agreed-upon services, Roisum Residential transfers limited copyright ownership of the resulting images to the Client and grants permission to share them — on social media, with family and friends, on vendor websites, and in print advertising — provided the images remain unaltered and Roisum Residential is credited in text where possible. The Client may not sell the photographs to a third party.

Advertising release

The Client grants Roisum Residential the irrevocable and unrestricted right to use and publish any photographs taken during the appointment for editorial, trade, advertising, educational, and any other purpose, in any manner and medium; to alter them without restriction; and to copyright them without restriction. The Client releases all claim to profits that may arise from the use of the images.

Limit of liability

If the assigned photographer is unable to perform under these terms due to injury, illness, an act of God, an act of terrorism, or any other cause beyond Roisum Residential’s control, we will make every effort to secure a replacement. If a suitable replacement cannot be found, our responsibility and liability is limited to the return of all payments received for the appointment.

If digital files are lost, stolen, or destroyed for reasons beyond our control — including but not limited to camera, hard drive, or equipment malfunction — Roisum Residential’s liability is limited to the return of all payments received for the appointment. For a partial loss of originals, the limit of liability is a prorated amount of the exposures lost, based on the percentage of the total number of originals. Roisum Residential is not liable for the loss of images beyond the earlier of the final delivery of all products included in the package or one year.

Capture & delivery

Roisum Residential is not obligated to deliver every image taken during the appointment. The selection of images delivered to the Client is left to the discretion of Roisum Residential.

Post-production & editing

The final post-production and editing — the styles, effects, and overall look of the images — is left to the discretion of Roisum Residential.

Payment schedule

The balance for all services and products is payable in full at the time of photo delivery. If the “Pay-at-Close” option is chosen, the Client must pay in full within 1–75 days of photo delivery, with the understanding that an additional 20% charge will be added to the total service fees.

If the Client fails to remit payment as specified, Roisum Residential has the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and begin charging interest of $10 for each additional day beyond 75 days from photo delivery. Returned checks are subject to a $50 non-sufficient-funds fee.

Pricing

Services or merchandise not included in the original booking are sold at the price in effect when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may be applied only toward merchandise purchased from Roisum Residential.
